1. Scope and Use

These Terms of Service govern the worldwide use of aiStager, an online service and web application for AI-assisted editing of real estate photos (virtual staging, decluttering, renovation, etc.). aiStager is operated by RedCorp OÜ (Registration No. 17061514, Sepapaja 6, 15551 Tallinn, Estonia). By using our website or web app, you agree to these terms. If you do not agree, you may not use the service. The service is provided "as is"; no specific outcome is guaranteed (e.g., a qualitatively perfect result for every image processing).

2. Registration and Account

Using aiStager requires registration. Each user may create only one personal account. Upon registration, each user receives a one-time credit of 5 free edits for testing. Abuse: Creating multiple accounts to obtain free credits more than once is prohibited. We reserve the right to suspend or delete such abusive accounts. You must provide accurate information during registration and keep your login credentials confidential. Account sharing (use of a single account by multiple people) is not permitted. Each person requires their own account; certain subscription tiers may include multiple user seats (e.g., Plus plan with up to 3 user accounts). You are responsible for all activities that occur under your account. You must be at least 18 years old or complete registration with the consent of a legal guardian. We may require suitable proof of age.

3. Credits, Subscriptions, and Payment

After consuming the free credits, a paid subscription is required for continued use. Our plans provide a monthly allotment of image-editing credits (e.g., 100 credits/month in the Pro plan). Billing occurs monthly or annually in advance, depending on the selected payment option. For annual subscriptions, monthly credits are still granted monthly (not as an annual lump sum). Credit validity and rollover: Unused credits do not expire immediately at month-end, but roll over to the next month. However, you can accumulate at most up to 3x your monthly allowance; any additional credits above this limit expire without replacement. Example: In the Pro plan with 100 credits/month, up to 300 unused credits can be carried over for use in subsequent months; anything above that expires. No payout/transfer: Credits are not money and are not transferable to other users. Unused credits cannot be paid out in cash and irrevocably expire when the contract ends. Cancellation: You may cancel your subscription at any time effective at the end of the current billing period. You can cancel via your account or in writing (email). After cancellation or non-renewal, any credits remaining at the end of the last subscription period expire. Please note that for cancellations of an ongoing annual subscription, there is generally no pro-rata refund for unused months (except under the money-back guarantee below). Prices and plan details are listed on our website. Payments are processed by our payment providers (e.g., Stripe). In case of payment arrears or issues, we reserve the right to temporarily suspend the account.

4. Money-Back Guarantee in the First Month

We want you to be satisfied with our service. Therefore, we offer a one-time 100% money-back guarantee in the first month of a new subscription. The conditions are: Period: The guarantee only applies to the first subscription month following the start of a new subscription (it does not apply to renewals or repeat sign-ups). Dissatisfaction: The guarantee applies only if none of the results generated in this first month were satisfactory to you. If even a single processed image met your requirements, the guarantee is excluded. Proof and request: To claim the guarantee, you must send us an email within the first month to our support and attach the relevant input images as well as the output images generated by aiStager, including an explanation of why you are dissatisfied. We will review the case promptly. Refund: If eligible, you will receive a full refund of the subscription amount paid in this first month. Refunds are typically issued to the original method of payment. Exclusion: Beyond the first month or in cases of partial satisfaction, there is no entitlement to a refund. The credits system generally does not include automatic crediting or refunding of consumed credits for unsatisfactory individual results—this is inherent to AI systems, where results are not always 100% consistent or predictable. However, we strive to find goodwill solutions on a case-by-case basis (e.g., granting additional credits) if you are dissatisfied with a result. Please feel free to contact us. This voluntary guarantee does not affect any statutory consumer rights or rights of withdrawal. In particular, by using the service early, the user expressly agrees that we begin performance before the end of any applicable 14-day withdrawal period; as a result, any statutory right of withdrawal expires if the conditions of §11 FAGG (Austria) and/or Art. 16 of the EU Consumer Rights Directive are met. Our money-back guarantee gives you additional assurance in such cases.

5. User Obligations and Content

Responsibility for content: You retain the copyright and all other rights to the images you upload to aiStager. However, you represent that you are entitled to use such content and grant us a worldwide, non-exclusive right to process your uploaded images for the purpose of providing and improving our service. This includes storing, copying, modifying, and displaying images to the extent necessary for image processing and the technical advancement of our AI system. We will not use or publish your content outside the stated purpose, and you can end our use of your content by deleting your account in accordance with our Privacy Policy. User obligations: You may use the service only within the law and in accordance with these terms. In particular, you agree not to upload content or take actions that: Are unlawful or infringe the rights of others—for example, do not upload images for which you do not hold the required rights (copyrights, trademarks, etc.), and do not upload content that infringes privacy or personality rights. If people are identifiable in photos, you must have their consent. Contain personal or sensitive data without authorization—please do not upload personal images (e.g., portraits, ID documents) or sensitive information unless strictly necessary. aiStager specializes in real estate photos and is not intended to process special categories of personal data. Are offensive or unethical—refrain from content that is pornographic, glorifies violence, discriminatory, harmful to minors, or otherwise inappropriate. We reserve the right to reject or remove such content. Are harmful or fraudulent—e.g., do not upload viruses, malware, or any other code that could damage the app or other systems. Do not attempt to circumvent security mechanisms or access areas for which you do not have authorization. Are abusive—do not use the service in a way that impairs its integrity, performance, or availability (e.g., automated mass uploading outside permitted API usage) or harms other users. Account use: As noted above, an account may be used only by the registered person. Sharing login credentials with third parties is prohibited. In team plans with multiple accounts, each access may be used only by the designated person. We reserve the right to temporarily or permanently suspend access for violations of these rules. Indemnification: You warrant that your use of aiStager and the content you provide do not violate third-party rights or any laws. You agree to indemnify us from all third-party claims arising from a breach of these representations. This means you will cover all justified costs (including reasonable attorneys' fees) incurred by us due to your breach and hold us harmless against such claims.

6. Data Protection and Use of Data

Protecting your data is important to us. Please refer to our Privacy Policy for details on data protection. It explains what data we collect and how we use it. In short: We collect necessary account data, usage information (e.g., number of images processed), and payment data to provide the service. We do not sell personal data. We treat uploaded images and generated output images (assets) confidentially. They may, however, be analyzed in an automated and anonymized manner to improve the quality of our AI system. If you do not wish this, you can inform us; however, please note that we are continuously learning to improve the service for all users. Personal data contained in images—if processed at all—is processed only within the scope of the service and in accordance with applicable data protection laws (in particular, the GDPR). Please avoid uploading sensitive personal images wherever possible, as mentioned in Section 5. If you nevertheless upload personal data, you warrant that doing so is lawful and that you have obtained any necessary consents from the data subjects. As the controller, RedCorp OÜ (operator of aiStager) processes your data in line with European data protection standards. You have the right to access, rectification, and deletion of your personal data; contact us at any time at support@ai-stager.com.

7. Warranty and Liability

Result quality: We strive to deliver high-quality and consistent results with our AI, but we do not provide a warranty for the quality or fitness for a particular purpose of the processed images. Due to the nature of AI technology, results may vary; there is no assurance that every image will meet your expectations. No specific characteristics are guaranteed. No refund of credits for dissatisfaction: If a processed image does not meet your expectations, this is inherent to the automated process. Consumed credits are not automatically credited back or refunded in such cases. Please use our money-back guarantee in the first month described above or contact support—we will try to help on a goodwill basis where possible. There is no general legal claim to this. Availability: We aim for high availability of aiStager, but we do not guarantee uninterrupted or error-free operation of the service. Short outages, maintenance windows, or technical issues may occur and do not give rise to claims for damages. We will inform you of planned maintenance in advance where possible. Limitation of liability: We are liable for damages—regardless of the legal basis—only in cases of intent or gross negligence on our part or that of our vicarious agents. In the event of slight negligence resulting in a breach of a material contractual duty (i.e., a duty whose fulfillment enables the proper performance of the contract and on whose compliance you may rely), our liability is limited to the typically foreseeable damage. In all other cases of simple negligence, we are not liable. Exception: The foregoing limitations of liability do not apply to personal injury (harm to life, body, or health) or to liability under mandatory statutory provisions (e.g., under product liability laws). In particular, to the extent permitted by law, we exclude any liability for indirect damages, consequential damages, or lost profits. We are not liable for the loss of data/images insofar as the damage is due to your failure to perform data backups. You should keep backup copies of your original photos.

8. Termination and End of Contract

Term of the contract: The contract for a paid subscription runs monthly or annually, depending on your choice, and renews automatically for the same term unless it is terminated in due time. Termination by the user: You may terminate your subscription at any time at the end of the respective term (see Section 3 for procedure). After termination, your account will revert to the free plan. Note that any unused credits will then expire. Reinstating expired credits after termination is not possible. Termination/suspension by us: We are entitled to terminate the contract without notice for good cause or to temporarily suspend your account, particularly if you significantly or repeatedly violate these Terms of Service (e.g., in cases of abuse, see Section 5). In such cases of extraordinary termination, you are not entitled to a refund of amounts already paid or replacement for expired credits. We also reserve the right to pursue civil and criminal remedies if your conduct is unlawful. Data after the end of the contract: If your account is deleted or permanently suspended, we may delete any remaining content after a reasonable period, provided there are no legal retention obligations. Please also read the notes in the Privacy Policy regarding data storage and deletion.

9. Changes and Final Provisions

Changes to the terms: We may adapt these Terms of Service in the future, for example due to changes in the service, legal requirements, or for security reasons. We will inform you of material changes in advance in a timely manner (e.g., by email to the address stored in your account or via a notice at login). If you do not object to the amended terms and continue to use our service after they take effect, this constitutes acceptance of the changes. If you disagree, you may terminate the contract before the new terms take effect. Credits already purchased or ongoing subscriptions will in that case be treated under the old terms until the end of the term; the change alone does not entitle you to special termination or a refund, provided that the essential primary services under the contract are not materially impaired. Governing law: Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer residing in the EU, the mandatory consumer protection provisions of your country of residence remain unaffected by this choice of law—you always enjoy the protection of your local law where it is stricter. Place of jurisdiction: For all disputes arising from or in connection with this contract, Vienna, Austria is agreed as the place of jurisdiction to the extent permitted by law. This applies if you are an entrepreneur or have no general place of jurisdiction in Austria. If you are a consumer residing in the EU, you may also bring claims before the courts of your place of residence. Severability clause: Should any provision of these Terms of Service be wholly or partially invalid, unenforceable, or void, the validity of the remaining provisions shall not be affected. In place of the invalid clause, the legally effective provision shall be deemed agreed that most closely approximates the economic purpose of the invalid provision. The same applies to potential gaps. No side agreements: These Terms of Service constitute the entire agreement between you and us regarding the use of aiStager. Any deviating terms and conditions you may have do not apply unless we have expressly agreed to their validity in writing.
